1. USE AND RULES OF USE OF "handmadestore.com.cy"

1.1 Access to the "handmadestore.com.cy" website and, by extension, participation in any service (e.g. viewing products through "handmadestore.com.cy", creating an account, purchasing products, etc.), is permitted exclusively to persons who have completed the tenth eighth year (18th) of their age and have full legal capacity.

1.2 Each Creator, User and Visitor expressly declares and guarantees that when using the services provided by "handmadestore.com.cy" they will provide true, accurate, valid and complete information about themselves and that they have the required legal conditions as well as the necessary ability to understand the terms and conditions contained herein. He also agrees to diligently maintain and update the information requested so that it is kept true, accurate, valid, updated and complete. The Company is not responsible for any use of the services by Creators, Users and Visitors who do not meet the above. 

1.3 The Company through "handmadestore.com.cy" enables the Creators, who can be either natural persons or companies, to promote their products to the Visitors and Users of "handmadestore.com.cy", for a specific time and/or quantity, such as defined each time and under the terms and conditions stated herein. 

1.4 Creators and Users must necessarily be the legal owner of the credit, debit, prepaid or other card with which they carry out their transactions and with which they take part in any of the services of "handmadestore.com.cy" or have express or implied approval of of its use by its legal owner. In no case is the Company liable to the legal owner of the card, if the Creator and/or the User are not its legal owners or do not have the legal authorization to use it from its legal owner.

1.5 Users and Visitors are not charged for using the services offered by "handmadestore.com.cy". Nevertheless, "handmadestore.com.cy" may provide links to third-party websites, which are owned by independent service providers and operate under the terms set by them. These third parties may charge a fee for the use of certain content or services provided through their website. Therefore, you should conduct any investigation you believe necessary or appropriate before entering into any transaction with any third party to ascertain whether a charge will be incurred. When "handmadestore.com.cy" provides information about charges on the website, such information is provided for convenience and information purposes only. The Company and "handmadestore.com.cy" in no way guarantee that such information is correct nor are they responsible in any way for content or services provided by such third party websites.

2. CREATOR VIEW

2.1 The products available for sale must be handmade, processed or resale products if they are materials & tools, vintage items or collectibles. The materials used to create the products displayed through "handmadestore.com.cy" must be of excellent quality resulting in the durability of the products in question. The Creator may offer for sale specific products that fall under the following categories: jewelry, clothing or footwear and accessories, artistic creations, works of art, gifts, household items, children's items, general household utensils and decorations, cosmetics and beauty products, as well as related and similar to the above goods, manufactured or designed from any kind of material (metal, leather, fabric, etc.) as well as materials & tools, and various collectibles. It is strictly forbidden to make any kind of food available for sale through "handmadestore.com.cy".

2.2 The Creator, when creating or modifying his store in "handmadestore.com.cy", invoices the products he will make available through the special form available for this purpose in "handmadestore.com.cy". The products are then displayed on the Creator's page and priced according to the Company's current pricing policy.

2.3 Each Creator has the freedom to modify at will the price of the products he has or to apply discounts either to specific products or to all the products he has. The Company, after collecting the revenue from the sales of each Creator at the end of each month, returns to each Creator the amount of money that is attributed to him based on what was stated in paragraphs 5.3 and 5.4 hereof and by the fifth working day of the following month.

2.4 By registering on "handmadestore.com.cy" and opening their store on the platform, each creator expressly states that they have read the Terms of Use & Privacy Policy and unconditionally accept them in their entirety. It also declares that it complies with the existing legislation for the manufacture of the products it has and has obtained the necessary licenses and certifications required in each case. It undertakes the obligation to inform in a clear and comprehensible manner the possible existence of allergenic ingredients in the products it manufactures.

2.5 The Company reserves the right to stop the promotion of the Creator's products free of charge for the Company when he does not comply with the terms of the Agreement.

3. REGISTRATION AND CREATION OF A USER ACCOUNT

3.1 Registration is not necessary to visit and complete the Visitor's purchases on "handmadestore.com.cy". However, creating an Account provides access to all services available from 'handmadestore.com.cy', as well as becoming a Creator of 'handmadestore.com.cy'. Upon registration, the Visitor becomes a User and is given the opportunity to save personal information and shipping addresses so that they do not need to be re-entered for each new order as well as the use of the Shopping Cart. In addition, by creating a personal Account, each User has the possibility to receive, if desired, informative emails from "handmadestore.com.cy".

3.4 The Company reserves the right to suspend or prohibit the use of its services to any User or Creator of "handmadestore.com.cy" who, at its sole discretion, does not comply with these terms of use, including providing incorrect registration information, maintaining more than one (1) account or attempting to interfere in any way with the operation of "handmadestore.com.cy". If a member is suspended or banned from using the services of "handmadestore.com.cy", he is not allowed to re-register or use the services of "handmadestore.com.cy" without the prior written consent of the Company.

4. ITEMS FOR SALE – PRICES

4.1 The products available for sale through "handmadestore.com.cy" are not products of the Company, but products of the Creators contracted with the Company, who display their products through the Website "handmadestore.com.cy" (Shop in Shop) , and therefore we bear no responsibility for them.

4.2 The products available for sale must be handmade, processed or resale products if they are materials & tools, vintage items or collectibles. The materials used to create the products displayed through "handmadestore.com.cy" must be of excellent quality resulting in the durability of the products in question. The Creator may offer for sale specific handmade or processed products that fall under the following categories: jewelry, clothing or footwear and accessories, artistic creations, works of art, gifts, home goods, children's goods, general household utensils and decorations , cosmetics and beauty products, as well as related and similar to the above goods, manufactured or designed from any kind of material (metal, leather, fabric, etc.) as well as materials & tools, and various collectibles. It is strictly forbidden to make any kind of food available for sale through "handmadestore.com.cy".

4.3 Each Creator undertakes that the products he displays through "handmadestore.com.cy" are not products of illegal activity. In any case, the Company bears no responsibility for any legal defect of a product displayed through "handmadestore.com.cy". Drawing up a sales contract between a Visitor or User and a Creator outside of "handmadestore.com.cy" is expressly prohibited, and in the event of a product sales contract being drawn up, "handmadestore.com.cy" bears no responsibility for the content of the sales contract or for the item being sold. In addition, in this case, the Company may deactivate a User or Creator account and gives the right to terminate it.

4.4 In particular, the Creator who displays and makes available cosmetics and beauty (personal care) products confirms that he complies with the applicable legislation for the manufacture of these products and has obtained the necessary licenses and certifications required as the case may be. In the specific products, the Creator undertakes the obligation to inform in a clear and comprehensible manner about the possible existence of allergenic ingredients in the products he manufactures, in order to protect the consumer public.

4.5 Each Creator is responsible for informing Visitors or Users about the availability of the products he has for sale with a relevant reference under the product description. For each special order, tailored to the taste of the Visitor or User regarding a product displayed by "handmadestore.com.cy", the interested party can communicate, by sending an internal electronic message, with the relevant Creator. "handmadestore.com.cy" may have access to such internal messages as described in this paragraph. In case of agreement, the Creator should re-post the product in question and display it as a "new product" so that the purchase process can be completed by the system.

4.6 The prices listed in the relevant catalogs next to each product include the applicable VAT. but not shipping costs, which are calculated at the final stage of the order. The prices refer to the products and the quantities available. Any adjustment of the prices of the products available for sale on behalf of the Creators, must be done after timely relevant information to the Visitors and Users.

5. ORDER

5.1 The submission of a product order constitutes a binding offer to purchase the product in question at the total price indicated when the order is submitted.

5.2 To order a product through "handmadestore.com.cy", each Visitor or User selects the products they want and adds them to their Shopping Cart. On the screen, the total cost of the order, including VAT, will be displayed. and expenses in accordance with the Company's respective pricing policy and minus any discounts to which the respective Visitor or User is entitled. The payment method will then be requested to complete the purchase. 

5.3 Upon completion of the order of the products, each Visitor or User confirms that he has been informed about the materials from which the products he wishes to buy are made, given that the Company bears no responsibility in case of allergic reactions, dermatological diseases and in general reactions that may arise from the products.

5.4 The order is completed upon its acceptance by "handmadestore.com.cy" by sending a confirmation email to the Visitor or User to the email address indicated by him when submitting the order.

6. METHOD OF PAYMENT - SHIPMENT OF ORDERS

6.1 The payment of each order is carried out with absolute security using a credit, debit or prepaid card of any Bank, through the SSL Security Protocol (Security Certificate & SSL Technology). It is also possible to pay either by cash on delivery or by depositing the amount payable to the account maintained by the Company.

6.2 The respective Bank is responsible for the security of transactions carried out through a credit or debit card that it has granted for the use of the Visitor or User. The Company and "handmadestore.com.cy" do not store personal information and data during transactions. However, in the event that a fraudulent use of a credit, debit or prepaid card has been proven, the charge may be canceled at the request of the Visitor or User to the Bank that issued the card, in accordance with the policy of the respective Bank.

6.3 After the completion of the order, the products it includes are sent at the expense of the Visitor or User to the place indicated when submitting the order with a courier company with which "handmadestore.com.cy" cooperates in order to ensure the maximum security of the shipping process . In any case, the Visitor or User will be informed of the shipping costs before completing each order. 

6.4 The shipping time of the product is subject to reservation due to the availability of the ordered product in the warehouses of the Creator's store as well as for reasons of force majeure (e.g. adverse weather conditions, strikes, etc.). In any case, an update will be sent via email for any delay.

7. CANCELLATION OF ORDER - RETURN OF PRODUCT

7.1 Cancellation of an order (in whole or in part) is possible by emailing "handmadestore.com.cy".

7.2 In the event that the ordering process has been completed but you are not completely satisfied with your purchase, you have the right to withdraw from the sales contract within fourteen (14) calendar days of completing the order, provided that the product is unused , in its original condition and without signs of wear. 

7.3 In case of non-receipt of the product due to the absence of the recipient, the product either remains with the Transport Company or is returned to the Creator. If the buyer wishes to set a new shipping and receiving date for the product, he must inform "handmadestore.com.cy" via email and after "handmadestore.com.cy" communicates with the Transport Company, a new shipping date will be set at the buyer's expense.

8. LIMITATION OF LIABILITY

8.1 The Company does not play an active role in the buying and selling of the products and therefore cannot guarantee the quality, safety and legality of the products available for sale on "handmadestore.com.cy" nor the destination of their use or any real and/or legal defects, nor the authenticity of purchase proposals made by each Creator, nor also the legal capacity and/or legality of Users and Visitors to purchase.

8.2 In the event of the sale of a product that is the product of a crime, in the event that an allergic or generally dermatological or other reaction is caused by the use of a cosmetic or other product or finally in the event of any dispute arising, the Consumers, Users as well as the Visitors shall be liable and release the Company from any and all liability, burden, damage, claim, expense, expense, including legal and/or costs arising and/or connected and/or related directly or indirectly to the products and/or to the successful outcome and the outcome of "handmadestore.com.cy" mission, i.e. the promotion of the Creator's product and the mediation between the Creator and the Consumer to draw up the contract of sale.

8.3 In addition, each Visitor or User indemnifies and releases the Company from any claim and/or claim for compensation for damage which may be asserted, for any reason, by Users for disputes between themselves or by third parties and which may result from a violation even and one of the terms and/or conditions contained herein, the obligations imposed by the Law or their rights, as well as from any demand or claim arising from alleged copying, falsification or imitation of products.

8.4 The Company has no responsibility for covering third-party claims, of any nature, which may arise in connection with the use, copying, or falsification of "handmadestore.com.cy" or its contents or any other connected website by unauthorized third parties from the Company persons. 

8.5 In the event that the Creator, after the completion of the sale, enters into a state of bankruptcy or dissolution and liquidation or forced administration resulting in the inability to deliver the product, "handmadestore.com.cy" has no obligation towards the Visitor or User for any disputes with the Creator. 

8.6 The Company does not provide a guarantee for continuous and uninterrupted access to "handmadestore.com.cy" and its services, given the possibility of obstruction, even partially, due to a random event and/or force majeure. Consequently, no responsibility exists for the temporary interruption of any of its services and/or inability to access "handmadestore.com.cy" as well as for any direct or indirect damages, costs and expenses that may arise from any interruption, malfunction or delays in the operation of the services provided, which will arise from the causes mentioned above. 

8.7 The Company bears no responsibility in the event that the ordered products do not reach the buyer after ordering them in perfect condition as well as in the event that they do not correspond to the description given by the Creator for them. However, the Company is obliged to make every effort to complete the orders in the best possible way. 

9. REVIEWS

9.1 The Creator unconditionally accepts that positive or negative evaluations of the products available through the "handmadestore.com.cy" website may be displayed on the website of the Provider Company, by any third party dealing with him, either a registered user or a visitor of "handmadestore.com.cy".

9.2 In the event that "handmadestore.com.cy" repeatedly receives negative evaluations for the Creator regarding any repeated failure, regarding the validity of the information provided by the Creator and displayed on the above website of "handmadestore.com.cy", the contracting parties acknowledge and accept the right of "handmadestore.com.cy" to terminate this contract without compensation and unilaterally and further by permanently removing him from the list of featured creators, through "handmadestore.com.cy".

9.3 The Creator is obliged to refrain from any act or omission that may manipulate the evaluations published on the website of the Provider Company - indicatively the provision of motivation for writing evaluations is mentioned - and in particular to refrain from publishing evaluations by himself, his employees or partners or to offer any consideration for the rating change. Violation of the obligations of this paragraph entitles "handmadestore.com.cy" to proceed with the temporary interruption of the services provided to the Creator or to terminate the contract between them without compensation and unilaterally.

9.4 The publication of any negative and/or positive reviews is potential and is at the sole discretion of "handmadestore.com.cy", which reserves the right to partially edit or delete at its sole discretion published reviews.

9.5 "handmadestore.com.cy" reserves the right, at its sole discretion, to ask the user for further information in order to publish the evaluation, if this is consistent with the text of the evaluation (such as photos of the received product). In the event that the user does not provide the information within a reasonable period of time from the date on which it will be requested, the evaluation will be considered invalid and will be deleted from the Website.

9.6 In the evaluations, it is not allowed to refer to the names and surnames of users or Creators, nor criminally infernal characterizations, slander, insults and generally content that is not consistent with the style of "handmadestore.com.cy". In the event that an evaluation with such content is received, "handmadestore.com.cy" reserves the right, at its absolute discretion, to either delete part of the text informing the editor of any modifications where this is deemed necessary, or to contact the editor via email to inform him that it is necessary to change the text for its publication, highlighting the disputed parts of it.

9.7 Only the author has the right to delete an evaluation without a specific reason and as long as it does not violate the terms of this present. In these cases, the editor should send a written notification to "handmadestore.com.cy" ( info@handmadestore.com.cy ) from the email account he/she stated when placing the order, with which he/she will request the deletion of the evaluation.

9.8 When publishing the review, the first name and the initial of the last name that the user has declared in "handmadestore.com.cy" will be displayed as the author, as well as the products that he bought from the Creator. Users who participate in 'handmadestore.com.cy' through social network registration accept that when their review is published any photo they have uploaded to the social network they used to register with 'handmadestore.com.cy' may appear, as the same applies to for users who have uploaded a photo to their 'handmadestore.com.cy' profile.

10. COMPLAINT

10.1 The Company may terminate its cooperation with the Creator with a written termination notified to him by any appropriate means. The denunciation produces its legal effects within thirty (30) days from the day after its notification to the Recipient.

10.2 The Company's denunciation produces its legal effects from the day after its notification to the Creator if: a) it is required by law or by a decision of a court or public authority or b) in case of repeated violation by the Creator of a provision of these terms.

10.3 The Creator may terminate his cooperation with the Company at any time by written notice communicated to it by any suitable means. The denunciation produces its legal effects from the next working day of its notification to the Company.

10.4 Termination of the contract does not affect the rights and obligations of the contracting parties that have been created up to the date of the effects of the termination.
